These Terms and Conditions ("Terms") govern your access to and use of Portofolia ("Portofolia," "we," "us," or "our") at portofolia.online and related services. By creating an account, subscribing, or using the service, you agree to these Terms. If you do not agree, do not use Portofolia.

Portofolia provides tools to build, customize, host, and publish online portfolios, including templates, media storage, and optional custom domains depending on your plan. Features may change over time; we will use reasonable efforts to notify you of material changes that affect paid features you rely on.

You must provide accurate registration information and keep your credentials secure. You are responsible for activity under your account. You must be at least 16 years old (or the age of digital consent in your jurisdiction) to use the service. One person or legal entity may not maintain multiple free accounts to evade limits or abuse the platform.

You agree not to use Portofolia to:

• Violate laws, infringe intellectual property, or publish unlawful content
• Distribute malware, spam, phishing, or attempt unauthorized access
• Harass, defame, or threaten others
• Overload or interfere with the service or other users' portfolios
• Scrape or reverse engineer the platform except as permitted by law

We may remove content or suspend accounts that violate these rules or pose risk to the service or third parties.

You retain ownership of text, images, and other materials you upload ("Your Content"). You grant Portofolia a non-exclusive, worldwide license to host, store, reproduce, display, and back up Your Content solely to operate, improve, and provide the service to you and your visitors. This license ends when you delete content or close your account, subject to reasonable backup retention described in our Privacy Policy.

You represent that you have the rights to publish Your Content and that it does not violate these Terms or third-party rights.

Paid plans, trials, and pricing are described on our site and at checkout. Where checkout is processed by Paddle, Paddle acts as merchant of record for those transactions; their terms and tax handling apply in addition to these Terms. Where we offer bKash or other manual payment methods, you must follow the instructions we provide; access is granted after we confirm payment.

Subscriptions renew automatically until canceled. Fees are non-refundable except as stated in our Refund Policy or required by law. You are responsible for applicable taxes not collected by our payment partners.

Portofolia owns the platform, software, branding, templates (as licensed to you), and documentation, except Your Content. You may not copy, modify, or create derivative works of our proprietary materials except as allowed by your plan or written permission. Feedback you provide may be used without obligation to you.

The service may integrate with third parties (hosting, email, analytics, payment providers, domain registrars). Their services are subject to their terms. We are not responsible for third-party outages or policies beyond our reasonable control.

You may stop using Portofolia and cancel paid plans at any time through billing settings or by contacting support. We may suspend or terminate access for breach of these Terms, non-payment, legal requirement, or extended inactivity on free accounts. Upon termination, your right to use the service ends; we may delete data after a reasonable period unless law requires retention.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE UNINTERRUPTED OR ERROR-FREE OPERATION, OR THAT YOUR PORTFOLIO WILL MEET SPECIFIC BUSINESS OR LEGAL REQUIREMENTS.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PORTOFOLIA AND ITS AFFILIATES, OFFICERS, AND SUPPLIERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR LOSS OF PROFITS, DATA, OR GOODWILL. OUR TOTAL LIABILITY FOR CLAIMS ARISING FROM OR RELATED TO THE SERVICE IN ANY TWELVE-MONTH PERIOD IS LIMITED TO THE GREATER OF (A) AMOUNTS YOU PAID US FOR THE SERVICE IN THAT PERIOD OR (B) USD $100, EXCEPT WHERE LIABILITY CANNOT BE LIMITED BY LAW.

You will defend and indemnify Portofolia against claims, damages, and costs arising from Your Content, your use of the service, or your violation of these Terms or applicable law.

We may update these Terms from time to time. We will post the revised version with a new "Last updated" date and, for material changes affecting paid users, provide notice by email or in-product when practicable. Continued use after changes take effect constitutes acceptance.
